Illinois Child And Spousal Support Attorney

Child Support

In child support cases in Illinois, custody determines who pays child support. Typically, the non-custodial parent pays child support to offset the costs of childrearing that the custodial parent must incur. The State of Illinois sets forth guidelines regarding how much child support the non-custodial parent must pay based on income:

  • 20% of net income for one child
  • 28% of net income for two children
  • 32% of net income for three children
  • 40% of net income for four children
  • 45% of net income for five children
  • 50% of net income for six or more children

These are guidelines that are often used by the courts, but they can be amended, given special circumstances. At the Law Offices of Gina G. Pattermann. P.C., we can help clients in Will, DuPage and Cook Counties who are facing unusual financial circumstances. We will present evidence to the court that supports your financial hardship to come up with a percentage that is fair, whether you’re the parent receiving the child support or paying it.

Spousal Support

Formerly known as “alimony,” maintenance is spousal support paid by the higher-earning partner after a divorce or legal separation. By definition, maintenance is designed to give both parties equal financial footing after the dissolution of marriage so that they can both continue to lead the same lifestyle as they did when they were married.

We will work diligently with the court to prove that you require a certain amount of spousal support based on your living expenses, childcare expenses (outside of child support), and other day-to-day costs. We will also verify your former partner’s financial paperwork to ensure that there aren’t any misrepresentations of income that might lower your spousal support amount.

We also frequently work with clients who are overpaying for child and spousal support. We have excellent research capabilities and are knowledgeable about common schemes people will use to try to hide income or assets. Contact us to set up a free consultation today.
